NAHB’s Legal Action Fund provides support for members facing critical legal challenges that directly impede their ability to develop land and build homes. The current deadline to apply for support is October 28.

Since 2020, more than $450,000 has been invested directly into cases shaping the legal and regulatory environment for home building. Resources, both monetary and expertise of NAHB legal staff, have been directed where they can have the greatest impact for all NAHB members:

Impact Fees

The single largest category of support has been litigation over impact fees, with $238,000 allocated to help members and state/local HBAs push back against excessive or unlawful fee structures.

Zoning and Land Use

More than $215,000 has supported cases challenging restrictive zoning practices and advancing more workable approaches to development, including:

  • Planned Residential District (PRD) zoning ($35,000)
  • General zoning challenges ($30,000)
  • Transit-Oriented Development ($35,000)
  • Efforts opposing affordable housing density bonus programs ($50,000)
  • Cases addressing design standards that impact housing affordability ($55,000)
