NAHB Announces Latest Round of Legal Funding for HBA Lawsuits
The NAHB Legal Advocacy and Compliance team is at the forefront of addressing legal challenges that impact home builders’ ability to deliver sustainable and attainable housing.
The Legal Action Fund provides financial support to members and HBAs engaged in litigation that could serve as legal precedent or have a meaningful impact on housing issues.
At the 2025 Spring Leadership Meeting, the Legal Action Committee reviewed several funding requests that reflect the growing complexity and urgency of legal threats facing the home building industry and awarded grants in three cases:
Georgia HBA Challenge to Development Ordinance
NAHB’s Board of Directors approved funding to support a Georgia HBA’s legal challenge to Paulding County’s new Planned Residential Development (PRD) ordinance. The ordinance imposes restrictive development limits, infrastructure mandates, and architectural standards that could significantly drive-up housing costs and reduce buildable density.
Desert Valley Builders Association (DVBA) vs. City of Coachella
DVBA continues its legal efforts to ensure transparency in how development impact fees are assessed. The latest Legal Action Fund grant will support DVBA’s appeal as they push back against what they argue is an opaque and unfair process.
Gas Ban Case: NYC Local Law 154
NAHB will also support a challenge to New York City’s Local Law 154. This law prohibits on-site fossil fuel combustion in most new buildings. The lawsuit, rooted in the federal Energy Policy and Conservation Act (EPCA), raises critical questions about federal preemption and energy choice.
Fall 2025 Application Deadline
