NAHB members have expressed concern about the mass deportation program instituted early in the second Trump Administration, which includes jobsite raids. Many residential construction business owners are wondering about their obligations and protections during an Immigration and Customs Enforcement (ICE) raid.

Generally, you should always ask to see a warrant and immediately contact your attorney if ICE agents show up on a jobsite. But immigration enforcement actions have taken many different forms in early 2025. For example, are the agents from ICE or from the U.S. Citizenship and Immigration Services (USCIS)? There is a difference.

NAHB’s legal team prepared a document during the first Trump Administration, When ICE Comes Calling, with best practices for business owners to use during ICE raids. After a recent review and updates, the document is accurate for 2025.
