On Nov. 5, 2002, the D.C. Circuit ruled in NAHB's favor, holding that the site-specific owl information was not exempt from FOIA and remanded the case with instructions to release the owl information. In so doing, the court noted that the public has an interest in the data because it contributes to an understanding of the operations and activities of the government. In April 2003, after months of further negotiations, FWS finally provided NAHB with the information that was first requested in 1998. NAHB also recouped some of its fees upon resolution of this matter.
