Amicus Brief Program

The NAHB Amicus Brief Program focuses on positively influencing federal and state appellate court opinions on issues important to the building industry and ensuring that the industry’s voice is heard in significant land use, builder liability, and environmental cases. NAHB files many friend-of-the-court briefs each year in compliment to our ongoing efforts in the Litigation Program. State and local builders associations may request amicus assistance for ongoing cases by using our Legal Action Fund process. Growth & Land Use Issues Amicus Briefs (4 items)
NAHB seeks out opportunities to submit amicus briefs that address regulatory takings, due process, and Fair Housing Act discrimination.
Environmental Issues Amicus Briefs (4 items)
NAHB frequently participates as an amicus in cases that address the Clean Air, Clean Water, and Endangered Species Acts.
Builder Liability Issues Amicus Briefs (6 items)
As an amicus, NAHB tackles construction defect and builder liability problems such as arbitration, insurance coverage, and mold.

Legal Action Fund Application Deadline

The Legal Action Fund is designed to help defray litigation costs for builders, developers and state/local associations who are involved in cases of national significance or exploring a common problem for the housing industry. If you are interested in a Legal Action Fund grant, apply now. The deadline for consideration at NAHB's 2009 International Builders Show in Las Vegas, NV, is Friday, December 4, 2009.
